How would I go about suing a state government?

We have a family member in prison who has served 90% of his sentence and is now gone through a rather long drown out process by the state of IL of which they intent to keep in prison for life after he has already been given his sentencing in 2000. i guess my problem is we are now wondering if we are going through a double jeopardy while the state is calling it civil commitment suit to hold him in prison for life. Can we sue the state government of IL for wrongful prosecution or anything to help them realize that we know what they are doing is wrong?
