I don't know what state you live in and what the laws are where you're at, but I have been involved with CPS in the past and I would say that NO, the Dr. would probably NOT be the one to take action. I would say that once the child is BORN, then CPS may be notified and the child likely screened for drugs, unless drugs is an issue that is caught by the Dr. before the child is born. If that is a problem the Dr. may notify CPS. I guess another issue would be the child that CPS already took...is the child permanently in foster care or in the process of reunification with her mother? It also would depend on how long ago all of this with the previous child occurred, although it will always be on her record. Bottom line is the hospital the new baby is born at will most likely be the ones asking questions and possibly making reports. I'm no expert, but I hope this helps.
