This is not legal advice. I believe that a living will is primarily used for medical emergencies. When it comes to custody of children when both parents are alive I believe that a more legal document other than a will is required. Guardianship of children can be challenged when one parent passes. Having a legal document signed and agreed upon by both parents which stipulates that if your daughter were to pass that at that time you would assume that role will be required. Never leave anything to doubt, get legal advice and create the right document that allows your daughter's wishes to go forward.
